Terms and Policies

You are advised to read these Terms and Conditions carefully as they contain important information regarding your legal rights, obligations and solutions. We reserve the right to amend these from time to time, and any changes will be posted on this page.
1. Introduction

1.1 Locations Reel Ltd (referred to as "Locations Reel", "us", "we", or "our" below) is an online platform that helps connect those seeking to hire a space or location for an event, a film shoot and/or photographic shoot, (referred to as “guests”, “hirers”, “users”, or “you” below) with people who manage or own a space suitable for the afore mentioned experiences and wish to hire it out (referred to as “users”, “you”, or “hosts” below) (collectively the “services”). The services are available through our website www.locationsreel.com (“site” or “platform”) and any other platforms through which we make our Services available.

1.2 These Terms and Conditions (referred to as “Terms” below) delineate all the rights and obligations, and any limitations and exclusions by which we, venues and Users abide by when using our Services. By using our platform you are deemed to have read, understood and agreed to all of the Terms set out below, including any updates published from time to time, and you agree to be bound by them. If you do not agree to any part of the Terms, then you have no right to use our platform.

1.3 Failure to use our platform in accordance with these Terms may subject you to civil and/or criminal liabilities and/or penalties and/or ban from our Platform.

1.4 If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.

1.5 The Site and Services are intended for responsible and serious use only and as such only persons who are 18 years of age or older, or businesses, Government agencies or instrumentalities, charitable institutions, partnerships, companies and sole traders will be able to benefit from our Site and Services as Guests or Hosts. Any access to or use of the Site or Services by anyone under 18 is expressly prohibited. By accessing or using our Platform, you represent and warrant that you are at least 18 years old.

2. Definitions

Booking – A booking of any Space or Listing made via our Platform, following a Booking Enquiry.
Booking Enquiry – A message sent to the Host by a User via our Platform or directly to the Host, showing interest in the Space and/or requesting information with regards to availability, prices or any preferences.
Booking Request Period – The time period starting from the time when a booking is requested by a Guest (as determined by Locations Reel in its sole discretion), within which a Host may decide whether to confirm or reject that booking request, as stated on the Site or Services. Different Booking Request Periods may apply in different places.
Cancellation Policy – The cancellation policy published by Locations Reel and which forms a term of this Agreement and which shall apply to all Listings and Hosts.
Commission – A percentage of the Hire Fee of the location in cause, chargeable to the Hirers upon booking a location found through our platform.
Content– All content that Locations Reel makes available through the Site, or Services, including, without limitation, text, graphics, images, music, software, audio, video, information or other materials.
Dashboard – A Members’ only platform, accessible via our Site. The Dashboard allows Users to manage their Spaces, send/receive Booking Enquiries, sign any agreements, and receive and make any payments due.
Deposit – A down payment which is calculated from the logistics of the hire of the location in cause. This is chargeable to the Hirer and is used as a safety bond in case there are any damages to the property after use.
Event Host – A Member who has a Listing of one or more Spaces on our platform available for hire for events.
Filming Host – A Member who has a Listing of one or more Spaces on our platform available for hire for filming shoots.
Guest/Hirer – A Member who requests from a Host the booking of its Space(s) through our Site or Services.
Hire Fee – The total price (excluding any taxes such as VAT) set by the Host and agreed with the Hirer. The Hire Fee is payable by the Hirer to the Host.
Hire Period – The period of time that the Hirer wishes to use the Location for, and for which any fees payable have been made, or an agreement has been signed; the duration includes Event or shoot days, plus any setting-up/reinstatement days.
Hosts – The collective term for all the Members that have a Listing of one or more Spaces on our platform, available for hire for all three types of experiences (Events, Filming and Photographic shoots).
Library Fee – An administration fee that the Hirer pays to Locations Reel, for handling a confirmed booking.
Listing – A webpage with the details of a Space that has been listed by a Host and made available for hire through our Site or Services.
Member – Anyone that completes a Location Reel’s account registration process, and agrees to be bound by these Terms and Conditions.
Pencil – A provisional booking, yet to be confirmed. It is treated on a ‘first come, first served’ basis, and only becomes a confirmed Booking once a Deposit has been made.
Photographic Host – A Member who has a Listing of one or more Spaces on our platform available for hire for photographic shoots.
Recce – A pre-shoot visit to a location chosen by the hirer, or production team, to assess the facilities and decide whether or not they are appropriate for the Shoot.
Shoot – The use of a Space by the Hirer, whether for the purposes of filming or photography.
Tax or Taxes – Any sales taxes, value added taxes (VAT), goods and services taxes (GST), transient occupancy taxes, fees (such as convention centre fees) that Hosts may be required by law to collect and remit to governmental agencies, and other taxes.
Users – Any person who engages with our Site or Services, and/or browses through our Listings.

3. Changes and Updates

3.1 Locations Reel has the right to change or update the Site and/or Services, as well as these Terms, at any time and without prior notice. Such modifications will be applicable to all Users and Services immediately after their publication, with exception of any bookings that have been confirmed or completed. Any changes or updates will be published on the Site. For an uncompleted Booking the Guest and the Host will receive notification that any modification has been made prior to completion of the Booking transaction. By continuing to access or use the Site, or Services after we have posted a modification on the Site or have provided you with notice of a modification, you will be deemed to have accepted that you will be bound by the modified Terms. If the modified Terms are not acceptable to you, then you should cease using the Site and Services.

4. Scope of our Site and Services

4.1 Locations Reel provides an online platform where Users can learn about Spaces available for hire for an event, a film or photographic shoot. These Spaces are made available through the Listings created by Hosts on the Site. Users can view the Listings either as unregistered or registered Users. Users intending to find a location for an event, they can enquire and book a space without having to register with us. For the purposes of filming and photographic use, Enquiries and Bookings can only be completed once Users are registered and have created an Account with us (Locations Reel Account).

4.2 Locations Reel provides an opportunity, and may even encourage, Users to leave feedback on their experience when dealing with you, the Host. This will translate into a star-rating system, which will reflect your response times, communication quality and overall satisfaction.

EVENTS
4.3 Locations Reel allows you (the Guest) to communicate directly with the Host, and make bookings and arrangements for payments and fees chargeable by the Host only. Locations Reel does not own any of the Spaces listed on our Platform, and does not manage or control any of the properties/venues listed.

4.4 All bookings are made directly between Guests and Hosts, so any contracts and agreements are accepted by you at your own risk. Locations Reel is not liable under any contract, arrangement or agreement made between Guests and Hosts, nor is Locations Reel a contract or agreement issuer for any Event Bookings.

4.5 Both the Event Hosts and Guests should ensure that all documents, such as insurances and safety checks, are in place before the event takes place. Locations Reel is not liable for any conditions of the Space before or after any bookings.

4.6 By joining our platform, and creating a Listing of a Space available for Event hires, you, as an Event Host, agree to respond to any Booking Enquiry facilitated by our Site and Services, to the best of your ability.

4.7 Event Booking Enquiries will reach Event Hosts in the form of phone calls and e-mails, depending on the contact details that you have made available on your Listing. Users will be encouraged to contact you directly. Locations Reel will not be involved in the process of Event Booking Enquiries.

FILMING AND PHOTOGRAPHY
4.8 Any communication between a Hirer and a Filming or Photographic Host is carried out directly, but via our communication system on our Platform.

4.9 The negotiation of fees is done so directly between the Hirers and Hosts, again, using our own communication system accessed via our Members’ Dashboard.

4.10 Any payments due to Locations Reel and the Host are made using safe and secure bank transfers directly between each bank, and not via third parties.

4.11 Upon confirmation of a booking, Locations Reel will provide our Users with our own agreement which can be adjusted and amended depending on each individual hire. These agreements are available to both the Hirers and Hosts and can be accessed via our Dashboard.

5. Account registration

5.1 In order for you to be able to fully benefit from our Services, such as send an enquiry to a Filming and Photographic Space, or create a Listing, you must first register with us and create a Locations Reel Account, to become a Locations Reel Member.

5.2 You can register to create an Account in different ways. The first is directly via our Site, from the menu bar made available to you. You can select the register/log in option, and follow the instructions to fill out the details needed to create the Account. Alternatively you can register with selected third-party social networking sites, including (but not limited to) Facebook and LinkedIn. By linking your Locations Reel Account with a third-party account (as permitted under the applicable terms and conditions that govern your use of the third-party account) you allow Locations Reel to access and store (if applicable) any content that you have provided to and stored in your third-party account, so that it is available on and through the Site, via your Locations Reel Account.

5.3 By creating a Locations Reel Account for your use within our Site, you agree to provide accurate, valid and current information, and to update it to keep it so. You may not have more than one active Locations Reel Account. Locations Reel reserves the right to suspend and terminate an Account if we deem that it has infringed any of the terms set in section 5.3. If your Account has already been terminated by one of our Representatives, we also reserve the right to refuse further attempts to create a new account by the same user.

5.4 You agree that you will not disclose your Locations Reel Account log in details, especially your password, with any third party. You are responsible for the safeguarding of your Account. You agree to take full responsibility of any activities carried out on our Site through your Locations Reel Account, whether or not you have authorised such activities. You will immediately notify Locations Reel of any unauthorised use of your Locations Reel Account.

5.6 Creating an account for the creation of a Listing, or to enquire about a filming or photographic space, will give you access to a members’ only area, our Members’ Dashboard. From the Dashboard, you will be able to manage your Listings, your Booking Enquiries and payments.

6. Space Listings

6.1 As a Host, you can create Listings. To create a Listing, you must first become a Member (see section 5) and answer questions about the Space to be listed, including, but not limited to, the location, the capacity, size, features, and an estimated pricing and any other financial terms associated with it.

6.2 You are alone responsible for providing and maintaining true, accurate, current, complete and non-misleading details about your Spaces.

6.3 In order to be featured in our platform, the Space to be listed must have a valid physical address. Locations Reel reserves the right to validate the information provided either through its own research, or by arranging a site visit.

6.4 Once you have completed your listing, a Locations Reel will moderate the Listing before putting it live on the platform and making it available to all our Users. This is done to ensure that your Listing meets our high quality standards. The standards are kept by, but are not limited to, good quality images of the Spaces, correct grammar and spellings, and overall good appearance.

6.5 If we believe that your Space has not met the above standards, a Locations Reel representative may offer advice on where improvements can be made, so that the Listing can be made available to the Users.

6.6 Locations Reel may offer you the option of having an in-house photographer shoot the Space, to create professional images for the Listing. If you decide to go ahead with this option, Locations Reel may or may not incur a charge, depending on travelling arrangements and size of the Space. This must be discussed with a Locations Reel representative prior to agreement. The photographs taken by a Locations Reel photographer will be made available to you to include in your Listing, with a watermark or tag bearing the Locations Reel Logo, which means they are verified by us. All images, materials and content created by these photographers, including verified Images, constitute Locations Reel Content, regardless of whether you include them in your Listing. You agree that Locations Reel may use the verified images for advertising, marketing, commercial and other business purposes in any media or platform, whether in relation to your Listing or otherwise, without further notice or compensation.

FILIMING AND PHOTOGRAPHY
6.7 For filming and photographic Listings, Locations Reel will create the profile on the behalf of the Hosts. The Hosts will be able to see the information and request any changes via our members’ Dashboard.

7. Obligations of the Event Hosts

7.1 You agree to respond to Booking Enquiries from Users or Locations Reel representatives within the Booking Request Period, otherwise the Booking Enquiry will be cancelled. You will receive Enquiries either via a telephone call or e-mail, depending on the contact details that you have provided on your Spaces’ profiles. As a general tip, we advise that all our Hosts ask people that enquire where they found their space, which will help give an idea of the number of enquiries received via our Site.

7.2 You will agree to respond to Booking Enquiries truthfully to ensure fair Service to the Users. Any errors in responding will be treated to be in favour of the User.

7.3 Once you have received a Booking Enquiry, it is then up to you to discuss with the Guest your space availability, any viewings to the property, fees and additional costs.

7.4 You may be contacted by a Locations Reel representative from time to time, to check if any Booking Enquiries have translated into actual Bookings. This will be done routinely, and its only purpose is to evaluate our Service and its success rate.

7.5 It is your responsibility to update your Listing(s) regularly, especially if any of the details provided change, such as the contact number, venue manager, or e-mail address. We recommend that Hosts add new sets of imagery to keep their Listing(s) up to date. Guests will enquire and book your Space using the information that is provided to them via your Listing, so make sure pricing and information is accurate and valid.

7.6 You acknowledge and accept that a Locations Reel representative may contact you to request any further details or information about your Space(s).

7.7 You are required to provide only truthful information. We will not accept any wrong information, such as incorrect e-mail addresses or phone numbers.

7.8 Any photos uploaded to your Listing on Locations Reel can be managed, adjusted and manipulated by Locations Reel. We reserve the right to remove any photos which do not meet our standards of high quality or that may be deceitful to our Users.

7.9 We have the right to remove your Listing with prior notice if we believe it is not up to standards, or it does not comply with our terms of use.

8. Obligations of the Filming and Photographic Hosts

8.1 You agree to respond to Booking Enquiries from Users or Locations Reel representatives within the Booking Request Period, otherwise the Booking Enquiry will be cancelled. All enquiries will be sent to you via our Site’s bespoke enquiry system. You will receive an e-mail to notify you of a new enquiry, and this may be followed by a phone call or text message to ensure that you do not miss the enquiry and the opportunity to convert it into a booking.

8.2 You will agree to respond to Booking Enquiries truthfully to ensure fair Service to the Users. Any errors in responding will be treated to be in favour of the User.

8.3 Once you have received a Booking Enquiry, it is then up to you to discuss with the Hirer your space availability, any recces to the property, fees and additional costs.

8.4 By using our Site and Services, both Filming and Photographic Hosts and Hirers are bound by our Cancellation and Refund Policies (See section 11).

8.5 It is your responsibility to request any updates to your Listing(s) regularly, especially if any of the details provided change, such as the contact number, venue manager, or e-mail address. We recommend that Hosts notify us of new sets of imagery to keep their Listing(s) up to date, or request that one of our representatives re-shoot the Space.

8.6 You acknowledge and accept that a Locations Reel representative may contact you to request any further details or information about your Space(s).

8.7 You are required to provide only truthful information. We will not accept any wrong information, such as incorrect e-mail addresses or phone numbers.

8.8 Any photos uploaded to your Listing on Locations Reel can be managed, adjusted and manipulated by Locations Reel. We reserve the right to remove any photos which do not meet our standards of high quality or that may be deceitful to our Users.

8.9 We have the right to remove your Listing with prior notice if we believe it is not up to standards, or it does not comply with our terms of use.

9. Obligations of the Guests/Hirers

9.1 At some point during the enquiry/booking stages you may be prompted to rate the Space(s) that you have been in communication with. This will be a simple star-rating system, which will be based on the Hosts’ response times, communication quality and overall satisfaction with the Space and booking. The rating is individual to the Spaces in cause, and should not in any way reflect your experience with Locations Reel as a Site and Services.

EVENTS
9.2 Locations Reel is not responsible for the performance of any confirmed bookings and making available any Spaces reserved through the Site. You, as a Guest, understand that entering a transaction with a Host for the booking of a Space, means that you are also entering into an agreement directly with, and between, you and the Host. By hiring a Space through our Site or Services with the intent of hosting an event, you understand and agree to any terms, conditions and policies regarding such Space and imposed by your Host. You acknowledge and agree that Locations Reel is not a party to the agreement made between you and the Host.

9.3 For any Event Bookings, or the hire of a Venue, all payments must be made directly to the Host. Locations Reel will not be held responsible for any transactions, such as deposits and hire fees.

9.4 In order to confirm and secure a booking for an Event Space, the Guest must agree on payment terms with the Host directly. The same goes for cancellation and refund policies – these must all be discussed with the Host prior to booking. Locations Reel will not accept any responsibility over these matters.

FILIMG AND PHOTOGRAPHY
9.5 When booking a location for the purposes of a film or photographic shoot, you accept and agree with our Cancellation and Refund Policies (see section 11) as well as our Payments and Fees that are applicable to any Filming and Photographic Bookings (see section 10).

9.6 In the case of Filming and Photography Bookings, or the hire of a Film or Photographic Location, all payment transactions must be done through our platform or Services.

9.7 If the Hirers wish to recce the location prior to a booking, this can be arranged with the Host directly through our communication system. A Locations Reel representative may or may not be present during the recce, as this will be arranged on a case by case basis. Hirers must first book a recce with the Host and confirm it before showing up to the Location, to avoid any disappointments. Hirers must also state the reason or type of recce, and the number of people present during the site visit.

10. Payments and Fees

10.1 Locations Reel does not charge any fees for using our services and platform. It is a free to use and browse website.

10.2 Locations Reel does not charge for any Listings or Registrations.

EVENTS
10.3 Any event bookings made via our Platform will not be subject to any commission charges. This includes to both the Guest and the Host. This means that bookings with an events space, found on our platform’s Event locations library, are completely free and do not cost our Users any money.

10.4 Users are therefore subject to each of the Venues’ own terms of use and payment. Locations Reel is not responsible for any such terms, and function under these Terms of Use solely.

10.5 Locations Reel’s business model does not currently include commission fees chargeable per event booking made via our platform. However, we do reserve the right to change this term, meaning we can introduce a commission fee on each event booking, chargeable to the Venues.

10.6 In the event of a commission fee being introduced in the future, Locations Reel will notify all of its Users, both Guests and Hosts, via e-mail. This notice, if given, will be done so with at least one week in advance.

FILMING AND PHOTOGRAPHY
10.7 Locations provided to us by Filming and Photographic Hosts will be subject to commission charges on bookings made via our Platform, Site and Services, or that arise from any introductions made by a Locations Reel representative. Such charges are applicable whether or not the booking is finalised through the Agent, and apply equally to repeat bookings.

10.8 Both Hirers and Hosts are subject to comply with our own payment, cancellation and refund policies, and must sign an agreement with us to finalise a booking.

10.9 Locations Reel offers the opportunity for our Users to carry out enquiries and bookings independently, by using our own automated system. Should any User/Hirer choose to use other services, such as directly approach one of our representatives for help with selecting a Location, or to request that one of our team members be present during a Recce, Locations Reel reserves the right to charge a Library Fee. The amount payable of the fee will depend on the logistics and extent of the services required.

10.10 In order to confirm a pencil, or confirm a Booking, Hirers must put down a Deposit/Bond (minimum of £400 or 20% of the total Hire Fee). The Deposit must be received by Locations Reel before the commencement date of the Hire Period.

10.11 No charge is made to our Users prior to confirmation of a Booking. After the confirmation, our Library Fee (if applicable) and the Deposit become due and are non-refundable (See our Cancellation and Refund Policies in section 11).

11. Cancellation and Refund Policies for Filming and Photographic Hires

11.1 If a Hirer chooses the cancel a Booking Enquiry that has not yet been confirmed, they can do so without being charged any fees.

11.2 If a Hirer wishes to cancel a confirmed Booking more than five (5) days before the first day of the Hire Period, any Hire Fees paid will be refunded in full as soon as practicable (and in any event, within 14 days). However, the Deposit and Library Fees (if applicable) will remain payable.

11.3 If a cancellation is made after the cut-off point (5 days prior to the commencement of the Hire Period), the entire Hire Fee and Library Fee (if applicable) will remain payable. This is also true if the cancellation is made after the Hirer and Host sign an agreement between themselves and Locations Reel, specific to the Booking in cause. Cancellation to the Host may be subject to different terms and conditions, imposed by the Host; by default it is Location Reel’s policy that the entire location fee will remain payable if less than five (5) days remain between cancellation and shoot commencement date.

11.3 Client satisfaction is paramount to us, and complaints will be assessed on an individual basis, and every effort made to find an amicable solution. Refund of the location fees after the cut-off point (and therefore after payment has been made to the location) will be subject to three-way negotiation and agreement between the Hirer, Locations Reel and the Host.

12. Third party websites

12.1 Locations Reel may occasionally include links to third party websites, or sites not operated by us. Such links are in no way or form endorsement or recommendations.

12.2 We have no responsibility over third parties’ websites and their contents. We cannot accept responsibility or liability for any damage or loss that may arise from using these third party websites.

12.3 Our platform uses Google Maps/Earth as well as some of Google’s APIs. Your use of Google Maps/Earth falls within Google Maps/Earth Additional Terms of Use.

1. Introduction

1.1 We are committed to safeguarding the privacy of our site users. In this Policy, along with other documents published on our Site, we explain how we will treat any personal information that you provide to us or that we obtain from you. By using our site and services, you acknowledge, accept and agree with our Privacy Policy. If you do not agree to any part of it, you must stop using our site and services immediately, and deactivate your Locations Reel account.

1.2 By using our site and services and agreeing to this Policy, you consent to our use of cookies in accordance with the terms of this Policy.

1.3 We will not share your personal information with third parties for marketing purposes.

2. Collecting personal information

2.1 We may collect, store and use the following kinds of personal information:

a) information about your computer and other devices about your visits to and use of our platform (including your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths);

b) information that you provide to us when registering with us or editing this information later (including your email address);

c) information that you provide when completing or editing your profile on our platform (including your name, contact details, profile picture, gender, date of birth and employment details, occupation or business);

d) information that you provide to us for the purpose of subscribing to our email notifications and/or newsletters (including your name and email address);

e) information that you provide to us when using the services on our platform (such as searching for or listing Spaces, making and responding to Booking Enquiries, communicating with other users) or information that is generated in the course of the use of those services (including the timing, frequency and pattern of service use);

f) information relating to any transactions that you enter into through our platform (including your name, address, telephone number email address, and bank details);

g) information that you post to our website for publication on your Locations Reel Account and Listing (including your username, your pictures and the content of your posts);

h) information contained in or relating to any communication that you send to us or send through our site, email, telephone or any other means (including the communication content and metadata associated with the communication);

i) any other information you provide to us when leaving a review or responding to a survey;

j) any other personal information that you choose to send to us; and

k) to the extent allowed by your settings on the third party site, information that you provided when created an account or profile with that third party site (such as Facebook or Google+) when you link that account or profile to with your Locations Reel account, or use it to register with us.

2.2 Before disclosing to us the personal information of another person, you must first obtain that person's consent to both the disclosure and the processing of that personal information in accordance with this policy.

3. Using your personal information

3.1 Personal information submitted to us through our site will be used for the purposes specified in this policy or on the relevant pages of the website.

3.2 We may use your personal information to:

a) administer and improve our website and business;

b) personalise our website for you and improve user experience;

c) enable your use of and access to our site and services available;

d) facilitate the booking of Spaces through our platform;

e) supply to you services purchased through our platform, such as photographers, booked recces and personalised packages of selected Spaces;

f) send statements, invoices and payment reminders to you, and collect payments from you;

g) send you non-marketing commercial communications (such as reminders, administrative notifications, changes to services, updates, messages and information about your Booking);

h) send you email notifications that you have specifically requested;

i) send you our email newsletter, if you have requested it (which you can unsubscribe from at any time);

j) send you marketing communications relating to our which we think may be of interest to you, where you have specifically agreed to this, by email or similar technology (you can inform us at any time if you no longer require marketing communications);

k) provide third parties with statistical information about our users (but those third parties will not be able to identify any individual user from that information);

l) deal with enquiries and complaints made by or about you relating to our website;

m) keep our website secure and prevent fraud;

n) verify compliance with the terms and conditions governing the use of our platform (including monitoring private messages sent through our website private messaging service);

o) to comply with our legal obligations with you and ourselves and/or with third parties;

p) to send communications out to you after the successful booking of a Space through our platform, as a means to monitor quality and receive feedback from your experience; and

q) to provide the highest quality of customer service.

3.3 If you submit personal information for publication on our website, we will publish and otherwise use that information in accordance with the licence you grant to us.

3.4 We will not, without your express consent, supply your personal information to any third party for the purpose of their or any other third party's direct marketing.

3.5 All our website financial transactions are handled through our payment services provider, Braintree. You can review the provider's privacy policy at https://www.braintreepayments.com/legal/payment-services-agreement. We will share information with our payment services provider only to the extent necessary for the purposes of processing payments you make via our website, refunding such payments and dealing with complaints and queries relating to such payments and refunds.

4. Disclosing personal information

4.1 We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this policy.

4.2 We may disclose your personal information to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) insofar as reasonably necessary for the purposes set out in this policy.

4.3 We may disclose your personal information:

a) to the extent that we are required to do so by law;
